Contractual OverviewThese Terms of Service govern the engagement between Dhillon Excavation & Concrete Ltd. and property owners, commercial developers, and general contractors throughout Ontario. All excavation, concrete forming, underpinning, and legal entrance installations are executed in strict accordance with the Ontario Building Code (OBC) and the Ontario Construction Act.

Acceptance of Terms
By browsing our website, submitting an inquiry for a free 24-hour site evaluation, signing an itemized quotation, or authorizing work on your real property, you (“Client”, “Property Owner”, or “You”) agree to be legally bound by these Terms of Service.
If a formal, signed Construction Agreement or Scope of Work document exists between you and Dhillon Excavation & Concrete Ltd., the specific provisions of that signed agreement shall supersede any conflicting general terms herein.

Estimates & 30-Day Pricing Validity
All preliminary quotations and 24-hour site evaluations provided by Dhillon Excavation & Concrete Ltd. are based upon visual surface inspections, client-supplied dimensions, and standard municipal soil classifications.
30-Day Guaranteed Pricing
Written quotations remain fixed and binding for thirty (30) calendar days from issuance. Beyond 30 days, quotes may be revised to reflect fluctuations in regional ready-mix concrete batch rates, fuel surcharges, and steel rebar commodity pricing.
Itemized Transparency
All formal proposals clearly separate machine excavation hours, soil haul-away tonnage, gravel compaction base, steel rebar reinforcement grids, concrete mix specs (e.g., 32 MPa / 4000 PSI), and city permit fees.

Scope of Work & Unforeseen Subsurface Conditions
Excavation and foundation work involve inherent subsurface variables. Standard estimates assume normal soil conditions (diggable clay, loam, or sand) free of hidden underground obstructions:
Unforeseen Underground ObstaclesIf during mechanical excavation our crews encounter solid bedrock requiring hydraulic hammer breakers, buried construction debris/foundations from previous structures, unmapped underground storage tanks, or high groundwater requiring continuous wellpoint dewatering, work will pause.
Written Change Order ProtocolNo additional work or supplemental machinery charges will be incurred without the property owner's prior review and written approval of an itemized Change Order.

Building Permits, Architectural Drawings & Ontario Code
All structural modifications — including below-grade side entrances, foundation cut-outs, basement underpinning, and retaining walls over 1.0 meter — must comply with the Ontario Building Code (OBC) and local municipal by-laws:
Turnkey Permit Services: Where contracted, Dhillon Excavation handles architectural drafting, P.Eng structural stamping, and city submission to Brampton, Mississauga, Toronto, Caledon, and surrounding GTA permit offices.
Mandatory Inspections: Work must pause for scheduled municipal building inspector sign-offs (e.g., footings inspection prior to concrete pour; framing and waterproofing inspection prior to backfill).
Owner Responsibilities: The Property Owner warrants that they hold legal authority over the property and confirms that lot grading will not unlawfully alter stormwater discharge onto neighboring properties.

Ontario One Call & Utility Locates
Under Ontario law, mechanical digging cannot commence until public underground utilities are marked:
Public Utilities (Ontario One Call)
Dhillon Excavation submits and manages all public locate tickets for natural gas (Enbridge), electrical hydro mains, municipal water/sewer, and telecom cabling prior to machine dispatch.
Private Property Utilities
The Property Owner is responsible for identifying any unmapped private installations not covered by public locates (e.g., private lawn irrigation lines, pool gas lines, underground dog fences, landscape low-voltage lighting).

Payment Schedules, Milestones & Ontario Construction Act
Payment structures are tied directly to verified construction milestones, providing complete accountability:

Milestone 1: Contract Signing & Permit Filing
Initial deposit upon contract execution and commencement of architectural drawings / city permit submissions.
Progress payment upon machine arrival, site digging, soil haul-away, and subgrade laser grading.

Milestone 3: Steel Rebar, Framing & Formwork
Progress payment upon complete rebar grid installation, gravel base compaction, and formwork inspection.

Milestone 4: Concrete Pour, Finishing & City Sign-off
Final balance due upon completed concrete pour, power-trowel finish/exposed aggregate wash, site cleanup, and city inspection approval.
All contracts are governed by the statutory holdback rules outlined in the Ontario Construction Act, R.S.O. 1990. Late balances beyond 30 days are subject to interest at 1.5% per month (18% per annum).

10-Year Structural Warranty & Concrete Care
Dhillon Excavation & Concrete Ltd. proudly stands behind every pour with comprehensive warranty protection:
10-Year Structural Integrity Guarantee
We warrant that all foundation underpinning, below-grade entrance walkdowns, and reinforced structural retaining walls will remain structurally sound and compliant with engineered load specifications for a period of ten (10) years from the date of completion.
Concrete Nature & Homeowner Curing Guidelines
Hairline Shrinkage: Concrete naturally shrinks as excess water evaporates. Hairline cracks (< 2mm) that do not affect structural performance are normal and are not considered structural defects.
Winter De-Icers Prohibited: Application of chemical de-icing salts (sodium chloride, calcium chloride) during the first 12 months of concrete curing voids the surface warranty. We recommend sand or cat litter for winter traction.
Vehicle Weight Restrictions: Heavy commercial vehicles (e.g., loaded moving vans, tri-axle dump trucks) must not drive onto residential concrete driveways.

Dhillon Excavation & Concrete Ltd. maintains comprehensive coverage for complete client peace of mind:
$5M Commercial General Liability (CGL)
Protects the client's home, surrounding structures, and neighboring properties against accidental damage throughout heavy excavation and machinery operation.
Full WSIB Workplace Coverage
All machinery operators, concrete finishers, and laborers are 100% covered under Ontario WSIB. Property owners are completely indemnified from on-site worker injury liability.

Site Access, Property Boundaries & Client Obligations
To facilitate efficient and safe construction, the property owner agrees to:
Provide unimpeded driveway and yard access for excavators, skid steers, and ready-mix concrete pump trucks during designated working hours (Mon–Sat, 7:00 AM – 6:00 PM).
Provide accessible outdoor water and 110V/15A electrical connections for tools, concrete mixers, and wet-saw diamond blades.
Ensure property boundary markers, pins, or surveyor stakes are verified before retaining wall or lot-line excavation begins.
Keep domestic pets and children safely inside or away from the active construction and excavation perimeter.

Weather Delays & Force Majeure
Excavation and concrete finishing are weather-dependent trades. Work may be rescheduled without penalty in the event of:
Torrential rain or extreme soil saturation that threatens trench wall stability or prevents proper subgrade compaction.
Sub-zero freezing temperatures below CSA concrete placement standards without specialized heated blankets or thermal curing additives.
Municipal permit office processing delays, labor strikes, or regional ready-mix concrete batch plant disruptions.

Cancellation & Contract Termination
If the client requests cancellation of an authorized project prior to machine mobilization:
Costs incurred for architectural drawings, engineering P.Eng stamps, city permit application fees, and customized ordering are non-refundable.
Remaining balance of any unearned deposit funds will be refunded within 14 business days.
Once machinery is mobilized or ground excavation has commenced, cancellation requires payment for all labor, machine hours, and materials supplied to date.

Governing Law & Dispute Resolution
These Terms of Service and all related construction contracts shall be governed by and interpreted in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein.
Both parties agree that any disputes arising from this agreement shall first be subject to good-faith mediation before the Ontario Superior Court of Justice in Brampton / Peel Region.
